Judge Brooks made a ruling on several motions that were filed by both sides one day before Duggar was due to appear in court on Thursday. Brooks denied Duggar’s motion to allow the prosecution to use a Facebook statement Duggar posted in 2015, in which he admitted to having a pornography addiction, as evidence.

However, the judge did mention that Duggar may be required to testify that he did NOT view pornography and was not addicted to it. The Government may also request that Duggar leave the courtroom to present the statement to prove his credibility.
The judge also denied Duggar’s motion to have the court stop him from suggesting to jurors that someone else may have committed these crimes. The filing states that “It is the burden of the Government to prove that Defendant has committed the crimes laid out in the indictment beyond a reasonable suspicion” and that Defendant is entitled, by pointing fingers at others who may have been able to commit the crimes, to create reasonable doubt in jurors minds.
In terms of a motion about sequestering witnesses, Judge Brooks ruled that “any witness who has testified – including the Government’s designated case agent sitting at counsel table – is prohibited from discussing the substance or his or her own testimony with any witness who has not yet testified and been formally excused from their obligations as a witness. The same sequestration rule applies to both the defendant and his witnesses.
He also noted that the Court’s rule doesn’t limit counsel from conferring on their own witnesses and preparing them for testifying.”

Duggar’s legal counsel wants to exclude 10 separate statements that he made, invoking his Fifth Amendment right not to be silent.
